What is Meningitis?

There are three membranes what surround your brain and spinal cord. These are the dura mater, arachnoid mater, and pia mater. Functionality wise, these three maters protect the central nervous system. When these matters become inflamed, it is deemed to be meningitis. As meningitis directly affects the nervous system and brain functionality, those which are diagnosed with meningitis should seek treatment immediately.

Meningitis is caused by external bacterium, viruses, fungi, parasites, and other contaminants to the system which weaken the immune system. In most cases meningitis is caused by coming into contact with a virus. In rare instances, meningitis can occur without the presence of a foreign contaminant to the three maters.

What are the Symptoms Common to Meningitis?

The most common indicator that someone has developed meningitis is a rash. This rash spreads very quickly over the body, and may at first resemble chicken pox. The spots may also resemble bruises and form into hives in some instances. Other symptoms include:Muscle spasms or pain

  • Nervous twitching or uncontrollable twitches
  • Muscle pains
  • Nausea or vomiting
  • Sudden spikes in temperature
  • Cold sweats
  • Frequent or continuous headaches

If you have any of these symptoms, you are advised to seek the diagnosis of a medical staff, doctor, or practitioner. Please be advised that just because you have these symptoms does not mean that you have meningitis. There are several illnesses which share common symptoms. However, if you believe that you have been misdiagnosed, seek a second opinion.

Is There a Risk of Permanent Damage Caused by Meningitis?

Due to the aggressive nature of meningitis on the nervous system, misdiagnosis may lead to permanent damage or death. Such damage may include the need to have ongoing oxygen therapy (through the use of a tank or from in-house treatment), anti-consultants for those with permanent nerve damage, or sedatives/ institutionalization for those whose mind has been altered causing irrational and/or dangerous behaviors.

Should I File a Meningitis Misdiagnosis Compensation Claim?

Meningitis can usually be treated is caught in its early stages with outpatient medication. Yet, if the diagnosis is faulty, the meningitis may develop to a critical state which requires hospitalization and perhaps permanent treatments. In such cases where the symptoms for meningitis were present and a professional medical staff, doctor, or practitioner should have been able to diagnosis you with such but failed to do so, you may have a claim.

If you were misdiagnosed and had to be hospitalized for meningitis, you should have grounds for a claim, especially if the diagnosis included medication which led to the acceleration of the virus upon the nervous system.

Those which have had a loved one die from misdiagnosis of Meningitis have grounds for a claim. In such cases medical documentation will need to be obtained to show the diagnosis of the medical staff, doctor, or practitioner. A coroner’s report stating that meningitis was the cause of death will also be required.

If you are or have had to undergo oxygen treatment of physical therapy as a result of being misdiagnosed you may have grounds for a claim, especially if the misdiagnosis occurred in the early stages when treatment could have been avoided. Also, if you are the primary caregiver of a person who was misdiagnosed and have had to contribute a substantial amount of your income to the ongoing treatment of the person due to this misdiagnosis, you may have grounds for a claim.

What Do I Need to Consider When Making a Meningitis Misdiagnosis Compensation Claim?

Misdiagnosis claims must be filed in a timely manner. The longer that a person waits to file a claim the less likely that person is to have a successful compensation claim. We will work with you to ensure that all documents are filled out properly and filed in the proper time.

In the event that someone has died as a result of Meningitis, a wrongful death claim may be the more appropriate action to take. Our office will discuss the specifics of your case to determine what claim is the best to file.

If you believe that you have been misdiagnosed as NOT having meningitis, you are advised to seek the professional opinion of a second medical staff, doctor or practitioner. If you have been diagnosed with acute meningitis ensure that you follow the treatment set forth by the person who diagnosed you. Do not stop treatment while filing your claim as your condition could become critical, resulting in permanent damage to your health or death.
