When is it possible to claim child injury compensation?
There’s no denying that accidents happen — all children face bumps, grazes, and tumbles at some point.
However, if your child has suffered any kind of injury that wasn’t their fault due to someone’s negligence, you may be entitled to claim compensation on their behalf. It is only worth claiming for injuries where an adult is clearly at fault.
Some of the most common child accident injuries worth claiming for include head injuries, broken bones, lacerations, and burns. You may also want to seek compensation for any other injury resulting in your child suffering long term conditions — such as cosmetic issues or severe health conditions.
There are a few scenarios where we advise seeking compensation for an accident that harmed your child, including:
- Schools and nursery accidents
Road traffic accidents, either as a pedestrian or a passenger - Birth injuries (as well as other injuries and harm) due to medical negligence, like a faulty cervical cerclage
- Playground and park injuries
- Slip, trip, and fall accidents
- Animal attacks, like dog bites
- Defective product and toy injuries
- Sport injuries due to negligence
If you aren’t sure whether you’re entitled to claim child injury compensation, please feel free to get in touch with Tylers Solicitors today via our online contact form or call 0800 699 0079 and we’ll be happy to help!
What evidence do you need for a child injury claim?
A big part of any successful compensation claim is proving that your child was harmed through no fault of their own. To do this, there are a few key pieces of evidence that can support your case.
If you do not have access to the evidence below, don’t worry — our solicitors can help gather everything you need to build your case:
- Medical records: Including any doctor’s reports, hospital records, treatment records, prognosis reports, or a psychological assessment if psychological trauma is involved.
- Proof of negligence: This will depend on the type of child personal injury accident you are claiming for, but examples include incident reports for school or nursery injuries, dashcam footage for road traffic accident injuries, and photos of unsafe play equipment for playground injuries.
- Photographic and video injury evidence: Including photos and videos of the injury, of the accident scene, and any CCTV or dashcam footage if available.
- Witness statements: Including your own account of the accident, your child’s, and statements from parents, teachers, bystanders, and other children (if parental consent is granted first).
- Lifestyle losses: Including medical expenses, travel costs, and special equipment costs if needed. You may also wish to keep an education report if the child’s injury or accident disrupted their learning.

How much can we claim?
How to make a child accident claim
Making a compensation claim for your child’s injuries can be an overwhelming process when you don’t know what to expect. With this in mind, take a look at the steps of our child accident claim process below.
- Initial consultation: After filling out our contact form, one of our solicitors will contact you to arrange an initial no-obligation consultation. We will discuss the details of your case and advise you on the next steps if we believe there is a claim to be had.
- Gathering evidence: To strengthen your case and claim, our child injury attorneys will look at any evidence you already have and collect more if needed. We may also arrange for an independent party — like a medical professional — to review your child’s injuries for supporting evidence if required.
- Assessing the case: Once all evidence is gathered, we will assess your child’s injury case to establish liability. After considering all injuries, losses, and damages, this will also help us determine your compensation amount.
- Claim filing: Once we have all the details and evidence we need, we will file your child’s personal injury claim on your behalf and handle all of the admin, including the legal aspects, negotiations, and paperwork. If the claim goes to trial due to the offending party disputing liability, our solicitors are also more than happy to fight your corner in court.
While each child accident compensation claim varies slightly, we can promise you this: from your initial enquiry to the moment you win your case, we support and guide you through the whole process.

How much compensation could you claim?
The general rule is: the more severe the injuries, the more compensation you could receive.
When it comes to child personal injury claims, the compensation amount varies on a case by case basis depending on a range of factors, such as the severity of harm, the long term impact of any injuries, financial losses involved, and if any psychological distress has been caused.
For a general estimate, however, we’ve put some figures together — take a look at our child injury compensation calculator below.

Child injury claims FAQs
Can I claim child injury compensation on behalf of my child?
If you are the child’s parent or guardian, you can file the child injury compensation claim on their behalf. You will act as a ‘litigation friend’ — someone who represents the child in legal proceedings.
How long do I have to make a child accident claim for compensation?
You have until the child turns 21 to make the child injury claim. However, if the child is under 18, you can claim as a parent or guardian anytime before their 18th birthday. If no claim is made while the child is under 18, the child can make the claim themselves from 18 until their 21st birthday.
It is important to note that there are a few exceptions to this time limit:
1. If the child injury claim involves serious brain injuries, there may not be a time limit if the child lacks the mental capacity to handle legal matters as an adult.
2. If the child injury was due to criminal assault, the claim will need to be made within 2 years of the assault under the Criminal Injuries Compensation Authority (CICA).
For more information, take a look at our FAQS or speak to one of our child accident and injury solicitors.
Can I gain access to my child’s injury settlement money in the UK?
No — not without a court order. Any compensation awarded from your child’s personal injury claim will be placed into the Court of Protection fund, where it will be invested and accrue interest. The child will be able to access the funds once they turn 18.
