What Do I Need To Know About My Compensation Claim?

Bone Cancer is a rare disease which is typically overlooked when trying to diagnose a patient. This is not to say that there are not professionals out these who see the signs and know to test for bone cancer, it is just stating that the cancer is so rare that few think to test for it. Does this mean that the practice should not be held liable for their neglect? No, most of the people who suffer from bone cancer have symptoms which any doctor, medical staff, nurse or practitioner can see as needing diagnosis, and even though the cancer is rare it should be identified and treated.

Are There Different Types of Bone Cancer?

There are typically four types of bone cancer. These are caused by bones which grow too quickly (such as in teens), radiation exposure, retinoblastoma, li-fragment, Paget’s disease, or genetic/generic condition which spark cell growth within the bone tissue. These four types are:

  • Osteosarcoma
  • Ewing’s Sarcoma
  • Chondrosarcoma
  • Spindle Cell Sarcoma

In most cases the cancer will affect the larger bones such as those found in the legs and pelvis. In some rare cases the ribs and the smaller bones (such as those of the hand and thumb area) are affected.

What are the Symptoms of Bone Cancer?

As stated, bone cancer is rare and so the diagnosis of bone cancer is somewhat puzzling. However, there are a few signs which should alert doctors to test and (if applicable) treat a person for bone cancer. These include:

  • Any discolouration around the bone and joint area
  • Swelling or inflammation of the bone area or joints
  • Inability to use a leg, arm, or other bone
  • Restrictive movements of any area close to a bone
  • Unexplainable fractures to a bone
  • Sporadic elevation of temperatures including night sweats
  • Severe and unexplainable weight loss

If you are suffering from any of these symptoms, it does not necessarily mean that you have bone cancer. However, if you think that you may be susceptible to having bone cancer, you are advised to get the professional diagnosis of a doctor, medical staff, nurse, or practitioner.

Should I File a Misdiagnosis Compensation Claim?

If you have shown symptoms which are traditionally associated with cancer and have not been advised to undergo cancer diagnosis and treatment, you may have grounds for a claim, especially if you were treated for another illness (including medication and/or surgery).

Those which have had fractures to their bones cause by bone cancer and were not diagnosed as having bone cancer may have grounds for a claim. If that individual has suffered from cancerous cells entering into the blood stream as a result of the breakage and neglect of the doctor, medical staff, nurse, or practitioner, you may have grounds for a claim.

Any person which has been diagnosed with bone cancer and has undergone chemotherapy or other such treatments only to find that they did not have bone cancer definitively have grounds for a claim, especially if there was no definitive testing and results presented to you concerning the misdiagnosis of your alleged bone cancer.

If a loved one has died as a result of misdiagnosis of bone cancer and has had an autopsy show that bone cancer was the cause of death, you definitively have grounds for a claim if the person was under the supervision of a nurse, practitioner, doctor, hospice worker, or other professional who should have been able to see the symptoms and diagnose it as potentially cancerous

If you have had to have an appendage amputated due to the spread of bone cancer which was not diagnosed properly or in a timely fashion then you may have grounds for a claim.

What Should I Consider When Making a Bone Cancer Compensation Claim?

Because bone cancer is so rare, it has to be shown that the symptoms were present or that another doctor, nurse, or practitioner would have diagnosed you as having bone cancer. Negligence claims are based upon the time when the claim was filed as well as the grossness of the neglect, the extent of the injury or pain, and other variables. It is essential that you file your claim as quickly as possible as there are timelines and procedural guidelines which must be met in order to receive any compensation.
